Permits, council and building disputes in Fraser Rise VIC

Fraser Rise is in the City of Melton, which deals with planning permits and report and consent. Your building permit, the mandatory inspections and the occupancy permit come from a registered building surveyor, who checks the work for the permit, not as your adviser. Those inspections do not give you a defect list. If a builder will not fix items you have raised in writing, the next step is the Building and Plumbing Commission's dispute resolution service (formerly DBDRV), then VCAT. The Commission, formerly the VBA, also registers and disciplines practitioners.

Melton City Council handles planning permits and report and consent in Fraser Rise.

Your Fraser Rise building permit and, at the end, the occupancy permit both come from a registered building surveyor.

The surveyor's mandatory inspections serve the permit and are not a defect inspection for you.

Disputes go to the Building and Plumbing Commission's dispute resolution service, then VCAT.

VCAT expects an expert witness report written to its practice note, separate from a defect report.

FAQ

Permits, council and building disputes in Fraser Rise VIC: common questions

Is the occupancy permit proof the house has no defects?

No. It confirms the building is suitable to occupy. A house can hold an occupancy permit and still have dozens of handover defects.

Can my handover report go to VCAT?

It supports your case with the builder, but VCAT expects an expert witness report drawn to its practice note, which we write separately.

Who should I contact first about a builder?

The builder, in writing, with the report attached. If that fails, the Building and Plumbing Commission's dispute resolution service.
